Terms and conditions
The terms that apply when your business buys EPOS hardware, software and services from us.
Last updated: 3 November 2026
These terms apply when a business buys EPOS hardware, software, online ordering, booking or related services from us, and when anyone uses this website. Please read them before you place an order. If anything in your quote or order form differs from these terms, the quote or order form wins.

2. Definitions
- “We”, “us”, “our”: the company named in section 1.
- “You”, “your”: the business that places an order with us.
- “Order”: the quote, order form or written confirmation that lists what you are buying, the prices and any minimum term.
- “Hardware”: equipment such as touchscreen terminals, printers, cash drawers, scanners, scales, handhelds, kiosks and kitchen screens.
- “Software”: the EPOS software, online ordering, booking and any other software or online service we provide or arrange.
- “Services”: set-up, installation, menu programming, training, support and any other work we do for you.
- “Monthly fee”: the recurring charge set out in your Order.
3. Business customers only
We sell to businesses, not to consumers. By placing an Order you confirm that you are acting for the purposes of your trade or business. Consumer cancellation rights, such as the 14-day cooling-off period for consumers, do not apply.
4. Quotes and orders
- A quote is valid for the period stated on it, or for 30 days if no period is stated.
- A contract starts when you accept our quote in writing (including by email or by signing an order form) or when you pay the first invoice, whichever happens first.
- Prices on this website are a guide. The price that applies to you is the one in your Order.
5. Prices and payment
- All prices are in pounds sterling and exclude VAT, which is added at the current rate.
- The system or set-up price is payable as set out in your Order. Unless your Order says otherwise, it is due before installation.
- Monthly fees are charged in advance for each month, by Direct Debit or another method we agree, from the date your system goes live or the date in your Order.
- If a payment is late we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and we may suspend the Software and Services until the account is paid (see section 13).
- We may change monthly fees after any minimum term by giving you at least 30 days’ written notice.
6. Minimum term
If your Order includes a minimum term, the monthly fee is payable for the whole of that term. After the minimum term the agreement continues month to month until either of us ends it under section 14.
7. Delivery, installation and set-up
- We will agree a delivery and installation date with you. Dates are estimates; we are not liable for a reasonable delay.
- You must give us access to the premises, a suitable power supply, a working internet connection and anything else listed in your Order.
- If we cannot install on the agreed date because of something on your side, we may charge for the wasted visit and a new date.
8. Ownership and risk
Risk in the Hardware passes to you on delivery. Ownership passes to you when we have received full payment for it. Until then you must keep it safe and insured and must not sell it or let anyone else claim it.
9. Software licence
- We grant you a non-exclusive, non-transferable right to use the Software in your business for as long as your agreement continues and your fees are paid.
- The Software and everything in it remain the property of us or our licensors. You must not copy, resell, reverse engineer or share access to it.
- We may update the Software to fix faults, improve it or meet legal requirements. Updates are included in the monthly fee unless we tell you otherwise in advance.
10. Your menus, prices and content
Where we program your menu, products or website for you, we use the information you give us. You are responsible for checking it before you go live and for keeping it correct, including prices, VAT rates, allergen and dietary information, age-restricted products and offers. You must have the right to use any logos, photos and text you send us.
11. Third-party services
Some services are provided by other companies, for example card payment processing, card machines, delivery platforms (such as Just Eat, Uber Eats and Deliveroo) and internet connections. Those services are covered by the provider’s own terms, which you accept with them. We are not responsible for their fees, settlement times, outages or decisions, but we will help you deal with them where we can.
12. Support and warranty
- We provide support for the Software and Hardware during the hours and by the channels we publish or set out in your Order.
- Hardware comes with the warranty stated in your Order. If no period is stated, the manufacturer’s warranty applies. We will repair or replace faulty Hardware covered by the warranty.
- The warranty does not cover damage from misuse, accidents, liquids, power surges, unauthorised repairs or software installed by anyone other than us.
- Work outside what your Order covers, such as extra site visits or changes you ask for, may be charged at our standard rates. We will tell you before we start.
13. Suspension
We may suspend the Software or Services, after giving you notice where we reasonably can, if you do not pay an amount when it is due, if you break these terms in a serious way, or if we need to protect the security of our systems. We will restore the service once the reason for suspension has been dealt with.
14. Ending the agreement
- After any minimum term, either of us can end the agreement by giving at least 30 days’ written notice.
- Either of us can end it straight away by written notice if the other seriously breaks these terms and does not put it right within 14 days of being asked to, or becomes insolvent.
- If you end the agreement during a minimum term (other than because we have seriously broken it), the monthly fees for the rest of that term become due.
- When the agreement ends, your right to use the Software stops. Hardware you have paid for in full stays yours. If you ask within 30 days, we will give you an export of your sales, product and customer data in a standard format where the Software allows it.
15. Data protection
Each of us will comply with UK data protection law. Our privacy policy explains how we use personal data about you and your staff.
When the Software stores personal data about your own customers or staff, you are the controller and we are your processor. We will:
- only process that data on your documented instructions and to provide the Software and Services;
- make sure our staff who can see it are bound by confidentiality;
- keep it secure with appropriate technical and organisational measures;
- only use sub-processors who are bound by equivalent terms, and tell you about them on request;
- help you respond to requests from individuals and to meet your own security and breach-reporting duties;
- tell you without undue delay if we become aware of a personal data breach affecting that data;
- delete or return the data at the end of the agreement, unless the law requires us to keep it; and
- give you the information you reasonably need to show that we meet these obligations.
16. Confidentiality
Each of us will keep the other’s business information confidential and only use it to perform the agreement, unless the information is already public or the law requires it to be disclosed.
17. Our liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
- We are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
- You are responsible for keeping your own records and for any cash, stock and takings at your premises.
- Otherwise, our total liability under or in connection with the agreement is limited to the total fees you paid us in the 12 months before the event that caused the claim.
18. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, such as power or internet failures, supplier shortages, extreme weather, strikes or failures of third-party services. We will tell you and do what we reasonably can to limit the effect.
19. Changes to these terms
We may update these terms. For existing customers, changes take effect 30 days after we tell you, unless the change is needed to meet the law sooner. The version on this page shows the date it was last updated.
20. Using this website
- We try to keep the information on this website accurate, but it is for general information only and may change without notice. Prices and specifications are confirmed in your Order.
- You must not misuse the website, for example by trying to break its security, sending spam through its forms or copying its content for commercial use.
- Links to other websites are provided for convenience. We are not responsible for their content.
21. General
- These terms and your Order are the whole agreement between us about their subject.
- You may not transfer the agreement without our written consent. We may transfer it to another business that takes over our obligations, and we will tell you if we do.
- Notices must be in writing and sent to the email or postal address each of us has given the other.
- If a court finds part of these terms invalid, the rest still applies.
- Nobody other than you and us has any right to enforce these terms.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
22. Contact
If you have a question about these terms or a complaint, contact us using the details in section 1.
